On March 4, 2016 the European Commission (EC) announced the start of a public consultation on the regulatory fitness of chemicals legislation and related aspects of legislation applied to downstream industries. The consultation was jointly published by two Directorate-Generals (DGs) of the EC, DG Internal Market, Industry, Entrepreneurship and SMEs (DG GROWTH), and DG Environment. It aims at obtaining stakeholder views on the functioning of the legislative framework for chemicals, focusing in particular on effectiveness, efficiency, coherence, relevance, and EU added value of the legislative framework.
This public consultation does not cover the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) legislation, for which a separate evaluation will be organized later this year. The chemicals legislation covered encompasses that on hazard identification and classification, as well as risk management, including worker safety and transport, environmental protection, chemicals control and product control provisions, and relevant supporting legislation. Among others, legislation pieces on Packaging and packaging waste (Directive 94/62/EC), Contaminants in food and feed (Regulation (EEC) No 315/93 and Directive 2002/32/EC) and Food contact materials (Regulation (EC) No 10/2011 and Regulation (EC) No 450/2009) are included. This public consultation is organized as an online questionnaire and is open until May 27, 2016.
